Posted: Friday, 4 January 2019 @ 13:43
When a person dies, somebody has to deal with their estate (money, property and possessions) by collecting in all the money and assets, paying all debts and tax, and distributing what is left to those people entitled to it.

At Human Law we deal with the administration of the estate of a loved one on your behalf. We understand that dealing with a loved one’s affairs can be time consuming, complex and often very stressful.

We will help take this worry away and deal with the matter in a professional and efficient way within a clear charging structure.

We offer a simple and straightforward service to our clients. Right from the start, we counsel you in a sympathetic advice which explains without the jargon, the probate procedure and what work we’ll be carrying out.

We keep you updated throughout the process.

There are two broad fee charging services:

GRANT ONLY SERVICE (What is a Grant of Representation?)

If you are seeking the costs of obtaining the grant only.

The obtaining of a grant of probate can be a time consuming and stressful task. It involves personal attendance at Court and higher court fees are payable on a personal application. We offer a service whereby we will prepare the papers to lead to a grant of probate and make application to the Court on your behalf.

For an estate worth under £500,000 the costs involved are:

Human Law Solicitors' fee £500.00
VAT @ 20% £100.00
Probate Court fee (to include 5 office copies of the grant) £50.00
Commissioner's fee on your swearing the papers £7.00

The fees quoted above are for obtaining the grant of probate only and do not include acting in the full administration of the estate.

Please note we shall require sight of the original Will and death certificate, and the executors will be required to produce identification to comply with money laundering regulations.

Alternatively if you wish us to take over the full administration of the estate, we offer the following:

TOTAL SERVICE

The fees we charge:

Human Law Solicitors' fee  £1,500/1.5% of estate value(whichever is higher)
VAT @ 20% 20% on above
Court fees and exhibit expenses will be added

We charge a competitive fixed fee based on the gross value of the estate (the Value Element) .We seek not to charge you an hourly rate and we seek to charge you a minimum fee a £1,500 plus Vat or a rate of 1.5% of the estate. (whichever is higher)

The fee applies to a value of £500,000.(the higher of the two fees will apply). This is a guideline price and applies in nearly all cases instructed.

A home visit of up to one and half hours is included within the price. Subject to the meeting taking place within the M25 area. Mileage fee of 40p/standard /rail fare added from our office.

All work is provided by a conscientious solicitor committed to helping you.

Excludes cases which involve disputed will or similar issues which involve too much complexity. A separate quote/hourly rate charge would be proposed, which you can accept or decline.

The fee needs to be paid within seven days of instruction; or you can pay by installments, or out of the funds of the estate.(an extra fee is applied which is around 1.5% of the estate).

Does not include conveyancing fees for sale of house; we can offer a fixed fee of £750 plus Vat or outsource the work to a lawyer of your choice.

In addition, on estates over £325,000 (£650,000 for married couple or those in civil partnership), there will be inheritance tax to pay.

* There may be some variations due to number of executors and exhibits.

Please note we shall require sight of the original Will and death certificate, and the executors will be required to produce identification to comply with money laundering regulations.
