The growth of mediation is being underpinned by the need to avoid lawyers

Please do not get me wrong. I am a solicitor(lawyer) and I work for clients on this basis. As a lawyer one can provide a truly excellent service which can be invaluable for clients.

Nevertheless there is a clear problem with using lawyers as the fees can be expensive whichever way you look though the support is vital.

Interesting news here that mediators will be asked to try and kick-start the multi-million-pound redevelopment of Bournemouth’s historic Pavilion Theatre.

The £46 million scheme has been put on hold because Bournemouth council has been unable to agree a land swap deal with the Meyrick Estate, which owns some of the Pavilion site.

Where things become interesting is the rationale for using mediation with Cllr John Beesley, deputy leader of the council, saying
Going to court would be more expensive, it’s of uncertain outcome and it doesn’t necessarily achieve what mediation can achieve. ...Various legal issues need to be resolved in order to go forward to a conclusion. I would hope that this process assists in doing that.”

Here is a politician who clearly gets one of the key reasons why you need to mediate rather than go to Court.
